Council Requirements

To remove a tree from your property you may need to apply for approval from your local council. Every council has a different tree management policy. Where you live and the type of work you intend to carry out, will affect whether or not you need to submit a tree removal development application.

There is no generic rule regarding tree removal in Ballina. Different rules apply according to the zoning restrictions applicable under the local environmental plan. You should seek advice from the Council prior to commencing any tree removal or native vegetation clearing on your land as you may need to submit a development application.

If the problem tree or shrub is on public land, such as parks, nature strips or road verges, you should contact the Council.

Under Lismore City Council's Tree Preservation Order (TPO) you must apply for Council consent to remove or prune certain trees. Fruit trees and weeds are generally exempt from the TPO. We recommend you contact the Council to confirm which trees you may prune or remove as strict penalties apply for infringements of the TPO.
